Main Objective:
This program offers a complete journey through the contractual, legal, and dispute resolution
aspects of construction projects, with a strong focus on FIDIC contract administration in the
Egyptian Law context. It builds a solid foundation in project contracting, develops skills in
interpreting and applying operational clauses, and enables participants to manage claims and
resolve disputes effectively. Through practical case studies and legal insights, the program ensures
graduates are prepared to navigate complex contractual challenges and safeguard project
outcomes with confidence.
Program Modules:
This program consists of the following 4 sections:
1. Fundamentals of Construction Contracting
2. FIDIC Operational Clauses
3. Claims Management in Construction Projects
4. Construction Dispute Resolution: DAAB & Arbitration
Timeframe:
The program is delivered over a period of two months, comprising 16 instructor-led sessions, with
two lectures held each week.
Section 1: Fundamentals of Construction Contracting
This section introduces participants to the core framework of construction projects and the
contractual environment in which they operate. It includes an introduction to FIDIC contracts,
parties involved in construction projects, the key objectives that guide delivery and the essential
contractual/construction documents that underpin successful project administration. By the end
of this module, participants will have a solid foundation for understanding how contracts,
stakeholders, and delivery methods interact in real projects.
Section 2: FIDIC Operational Clauses
This module examines the key administrative clauses of the FIDIC 1999 Red Book, showing how
they are applied in practice and adapted under the Egyptian law. A detailed exploration of the key
FIDIC clauses is presented, reinforced by real case scenarios that illustrate their practical influence
in project administration. By the end of this module, participants will be able to interpret and
apply FIDIC’s operational clauses confidently within the Egyptian legal framework.
Section 3: Claims Management in Construction Projects
This module delivers a comprehensive examination of construction claims, starting with their
common causes and classifications, and progressing through the contractual and procedural
requirements. It offers practical guidance in identifying the key elements of construction claims,
compiling robust documentation, and navigating the appropriate procedural steps. The module
also introduces strategies for escalating disputes when early resolution efforts prove
unsuccessful, ensuring participants can transition from initial negotiations to formal dispute
resolution mechanisms. By the end of this module, participants will be equipped with the
knowledge and practical skills to prepare well-founded claims, substantiate them effectively.
Section 4: Construction Dispute Resolution: DAAB & Arbitration
This module provides an in-depth focus on formal dispute resolution mechanisms under FIDIC,
beginning with the DAAB and transitioning into arbitration. It equips participants with the
knowledge to navigate these processes effectively, from initial referrals to final determinations,
while understanding the underlying principles and legal frameworks that govern them. By the end
of the module, participants will be prepared to manage complex disputes with confidence and
precision. The section is concluded by presenting real arbitration construction arbitration cases.
